2. Filing a DMCA Takedown Notice

To be valid, your notice must include:

2.1 Required Elements

  1. Your signature (physical or electronic)
  2. Identification of the copyrighted work claimed to be infringed:
    • Title, author, registration number (if applicable)
    • URL or other identifier if work is published online
  3. Identification of the infringing material:
    • Specific URLs of pastes containing the infringing content
    • Screenshots or specific text excerpts (if applicable)
  4. Your contact information:
    • Full name, mailing address, telephone number, and email
  5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

2.2 Example Notice Template

3. Our Response to Valid Notices

Upon receiving a valid DMCA notice, we will:

  1. Remove or disable access to the allegedly infringing content promptly
  2. Notify the user who posted the content (if account exists)
  3. Document the takedown in our records
  4. Terminate repeat infringers as appropriate

3.1 Processing Time

  • Valid notices are processed within 2-5 business days
  • Emergency takedowns (e.g., child exploitation) are processed within 24 hours

3.2 Encrypted Content

For paid pastes (encrypted at rest):

  • We cannot inspect content before taking action
  • Takedown disables unlock mechanisms and removes wrapped content keys
  • Original uploader is notified via email (if account exists)

4. Counter-Notification (Restoring Removed Content)

If you believe your content was removed in error or misidentification, you may file a counter-notification.

4.1 Required Elements

Your counter-notification must include:

  1. Your signature (physical or electronic)
  2. Identification of the removed material:
    • Paste URL or slug before removal
    • Description of content
  3. A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
  4. Your contact information:
    • Full name, address, phone, and email
  5. Consent to jurisdiction:
    • You consent to the jurisdiction of the Federal District Court for your district (or where we are located if outside the US)
    • You will accept service of process from the complainant

4.2 Example Counter-Notification Template

5. Our Response to Valid Counter-Notifications

Upon receiving a valid counter-notification:

  1. We will forward it to the original complainant within 2 business days
  2. We will inform them they have 10-14 business days to file a court action seeking an order to restrain you from infringing activity
  3. If no court action is filed, we may restore the content after 10-14 business days

6. Repeat Infringer Policy

6.1 Three-Strike Policy

  • First offense: Content removed, warning issued
  • Second offense: Account suspension for 30 days
  • Third offense: Permanent account termination

6.2 Circumvention

Creating new accounts to evade termination will result in immediate permanent ban and potential legal action.

6.3 Exceptions

  • False or bad-faith DMCA notices do not count as strikes
  • Successful counter-notifications clear the strike

7. Misrepresentation and Abuse

7.1 Penalties for False Claims

Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that:

  • Material is infringing, or
  • Material was removed by mistake

is liable for damages, including costs and attorney fees.

7.2 Abuse Prevention

We reserve the right to:

  • Reject notices that lack required elements
  • Ban users who file frivolous or abusive notices
  • Report persistent abusers to law enforcement

8. Limitations and Disclaimers

8.1 No Obligation to Monitor

We are not obligated to monitor content or seek facts indicating infringement.

8.2 Safe Harbor

We operate under DMCA safe harbor provisions (17 U.S.C. § 512(c)) as a service provider with no knowledge of infringing activity.

8.3 Not Legal Advice

This policy does not constitute legal advice. Consult an attorney for legal guidance.

9. International Copyright

9.1 Jurisdictional Issues

  • We comply with DMCA (US law)
  • For non-US copyright claims, similar procedures apply
  • Provide equivalent documentation under your jurisdiction's laws

9.2 Berne Convention

We respect copyright under the Berne Convention and reciprocal international treaties.

10. Appeals and Disputes
